EPA Construction General Permit (Stormwater)

Stormwater/erosion permit required when a job disturbs one acre or more. In New Mexico apply to EPA (not NMED).

Who needs it

Any project disturbing 1+ acre, or a smaller part of a larger common plan totaling 1+ acre.

Steps to get it

  1. 1 Determine if the job disturbs 1+ acre (or is part of a larger 1+ acre plan).
  2. 2 Develop a Stormwater Pollution Prevention Plan (SWPPP) with erosion/sediment controls.
  3. 3 File a Notice of Intent (NOI) through EPA NeT system before disturbing ground.
  4. 4 File a Notice of Termination (NOT) once the site is stabilized.

Authority & citation

Clean Water Act Sec. 402; NPDES (40 CFR 122). New Mexico is a non-delegated state, so EPA is the permitting authority.
